Petitioner seeks issuance of passport, however, the police verification report requisitioned by opposite party no.2 is adverse in the sense that it mentions about a criminal trial pending against the petitioner arising out of Crime No.0262/2020 under Sections-504, 323, 324 I.P.C., P.S.-Asivan, District- Hardoi. Petitioner's counsel says that though chargesheet has been filed in the said case but petitioner's name does not figure therein. Petitioner relies upon a certified copy of the chargesheet which is annexed as Annexure no.5 to the petition. The submission is that there were two accused initially, both named Rijavan Khan but father of the one i.e. the petitioner was Jaheer Khan whereas father of the other was Munna. Chargesheet has been filed against Rijavan Khan son of Munna and not Rijavan Khan son of Jaheer Khan. 4. Accordingly, this petition is disposed of with a direction to the newly impleaded opposite party no.3 to send a fresh police verification report to opposite party no.2 within fifteen days specifically indicating as to whether petitioner is named in the chargesheet which has been filed in the aforesaid case or not. Petitioner i.e. Rijavan Khan son of Jaheer Khan is mentioned in the chargesheet or not and whether any investigation against the petitioner in respect of this case is still pending.
