RaghunandanRao) The writ petitioners herein, claiming title over Ac.6.03 cents of land in of Chinarangapurarn Village, Pulivendula Mandal, Y.S.R. Kadapa District. The Andhra Pradesh State Financial Corporation, had sold under Section 29 of the State Financial Corporation Act, 1951, Ac.6.03 cents of land situated in various surveys of Chinarangapurarn Village, of Y.S.R. various surveys 2 RRRJ & Dr.KMRJ W.A.No.340of2024 Kadapa District to one Sri Pulla Reddy. Subsequently, his legal heirs, who are writ petitioners herein, had presented the document of alienation for registration. The Sub-Registrar, Pulivendula, by an endorsement, dated 18.10.2021, had refused to register the same. Aggrieved by the said endorsement of rejection, the writ petitioners approached this Court, by way of W.P.No.29150of2021. A learned Single Judge of this Court, after hearing the writ petitioners as well as the respondent authorities was pleased to dispose of the Writ Petition with a direction to the Sub-Registrar to receive, register and release the 2. document. Aggrieved by the said judgment, the writ appellant, who is a third party to the Writ Petition has approached this Court, by way of the present Writ 3. Appeal. The case of the writ appellant, in short, is that the title to the said land can be traced to Sri V. Bhaskar Rami Reddy and Sri Venkata Rami Reddy, who are brothers. It is the case of the appellant that the land in question belonged to Sri Venkata Rami Reddy, who had sold the land to the appellant. However, Sri V. Bhaskara Rami Reddy, who had no title to the said land mortgaged the property to M/s. A.P.S.F.C., which sold away the land for recovery of dues from Sri V.Bhaskara F^ami Reddy. The writ appellant would contend that, in view of the running dispute relating to this property, he has filed, O.S.No.86 of 2023 before the learned IV Additional District Judge, 4. 3 RRR,J & Dr.KMR,J W.A.No.340of2024 Kadapa District, and an ad-interim injunction order, in I.A.No.1120 of 2023, in O.S.No.86 of 2023, had also been issued, on 18.12.2023, injuncting the writ petitioners/respondents herein from alienating any part of the said land. The appellant would also contend that, in such circumstances, registration of a sale deed in favour of the writ petitioners/respondents would go against the essence of the injunction granted by the learned IV Additional District Judge, Kadapa District, in O.S.No.86 of 2023. C 5. Sri V. R. Reddy Kovvuri, learned counsel for the writ petitioners/respondents would contend that the land belongs to Sri V. Bhaskara Rami Reddy and the execution of mortgage over the said land in favour of M/s. A.P.S.F.C. and subsequent sale of M/s. A.P.S.F.C. is in accordance with law. 6. It is submitted by Sri V.R. Reddy Kovvuri, learned counsel for the writ petitioners/respondents that the deed of sale presented by M/s. A.P.S.F.C. has already been registered in favour of the writ petitioners and the document has also been released. 7. In these circumstances, this Writ Appeal is disposed of holding that the registration of the said sale deed will be subject to the result of the suit. In the event of the suit being allowed in favour of the writ appellant, the deed of sale registered as document No.3289 of 2023, in the office of the Sub-Registrar, Pulivendula,shall stand cancelled. If the suit is dismissed, in favour of the writ petitioners/respondents, nothing further needs to be done. 4 RRR,J & Dr.KMRJ W.A.No.340 of 2024 The same result would apply to any Appellate Proceedings that may be 8. initiated by either side against the Orders of the learned IV Additional District Judge, Kadapa District, in relation to O.S.No.86 of 2023.
