Neutral Citation No. - 2025:AHC:14059 Court No. - 5 Case :- WRIT - A No. - 1106 of 2025 Petitioner :- Dhiraj Mishra Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Pradip Kumar Srivastava Counsel for Respondent :- Anuj Pratap Singh,C.S.C. Hon'ble Ajay Bhanot,J. Heard Shri Pradip Kumar Srivastava, learned counsel for the petitioner, learned Standing Counsel for the State- respondents No. 1 & 2 and Shri Ambrish Shukla, learned counsel for the respondent No. 3. The petitioner claims that objections regarding the seniority list are pending before the respondent No. 3 i.e. Chief Executive Officer, U.P. State Industrial Development Authority, Kanpur. A representation in this regard has been made for expeditious decision of the same but to no avail. Shri Ambrish Shukla, learned counsel for the respondent No. 3 submits that the matter requires factual determination and adjudication of inter se rights of the parties as per applicable law by the competent authority in the first instance. He however, fairly contends that the claim of the petitioner as per law has to be decided by the competent authority within a reasonable time frame. In wake of the preceding discussion and without going into the merits of the case, the respondent No. 3 i.e. Chief Executive Officer, U.P. State Industrial Development Authority, Kanpur is directed to decide the representation of the petitioner regarding seniority as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of the representation after hearing necessary parties. With the aforesaid direction, the writ petition is finally disposed of. Order Date :- 27.1.2025 Jaswant Digitally signed by :- JASWANT KUMAR High Court of Judicature at Allahabad
