Mr. S.M.Suna, learned counsel for the petitioner has submitted that during the pendency of the instant application, 70% of the stretch for construction of the Mawshun Bye Pass of NH 40 has since been completed. He therefore submits that as the construction has gone ahead, the matter at this stage, has been rendered infructuous. 2.
