1. The prayer made in the present petition is for quashing the order dated 16.05.2024, whereby the application preferred by the petitioner for transfer of appeal filed by him under Section 7(3) of the Control of Building Operation Act, 1988 against the order of dated 17.10.2022, from Bench-III to any other available Bench, has been rejected.
2. Though respondent No. 3 has filed the response, but learned counsel for respondent No. 3 submits that he has no objection if the appeal is transferred to any Bench of the J&K Special Tribunal, Jammu, particularly in view of fact that vide order dated 20.01.2025, passed by this Court, the operation of the order impugned has been stayed.
3. Mr. Mayank Gupta, learned counsel submits that appropriate orders may be passed.
4. Without commenting upon the merits of the order dated 16.05.2024, and in view of the statements made hereinabove, the present is disposed of by Serial No. 87

transferring the appeal filed by the petitioner pending before Bench No. III to Bench No. II of the J&K Special Tribunal, Jammu.
5. Bench No. II is requested to decide the appeal as expeditiously as possible in accordance with the law after affording opportunity of hearing to the contesting parties. Since the petitioner has not caused appearance before this Court, as such, the learned Tribunal shall issue notice to him, in the event, he does not cause appearance before the learned Tribunal.
6. The record of the appeal shall be transferred from Bench No. III to Bench No. II.
