2025:JHHC:14773 IN THE HIGH COURT OF JHARKHAND AT RANCHI A.B.A. No. 2733 of 2025 ----- Jubair Akhtar @ Zubair Khan, S/o Nizamuddin Khan, R/o Village- Chetra, P.O. and P.S.- Garhwa, District- Garhwa .... Petitioner(s). Versus The State of Jharkhand … Opp. Party(s). ------ CORAM : SRI ANANDA SEN, J. ------ For the Petitioner(s) : Mr. Abhay Kr. Chaturvedy, Advocate For the State : Mr. Manoj Kumar Mishra, AddI. P.P. …...... 04/ 09.06.2025: Heard, learned counsel for the petitioner and learned counsel for the State. 2. This is an application filed by the petitioner praying for grant of anticipatory bail in terms of Sections 482 and 484 of Bharatiya Nagarik Suraksha Sanhita, 2023 apprehending his arrest for the offences under Sections 115(2), 126(2), 109, 117, 303(2) and 3(5) of Bharatiya Nyaya Sanhita, 2023. 3. Learned counsel for the petitioner submits that allegation is fake. He further submits that there is nothing in the F.I.R. to suggest that petitioner was armed with sharp weapon and the nature of injury also does not suggest there was intention to commit murder of the informant as the same is on leg. 4. Learned A.P.P. representing the State opposes the prayer for anticipatory bail. 5. After hearing the parties, I have gone through the F.I.R. there is allegation that this petitioner along with other unknown persons came and assaulted the informant, who sustained injury. 6. Considering the nature of allegation as there is allegation of assault by this petitioner and others, I find that this is not a fit case for grant of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner in connection with Garhwa P.S. Case No.07 of 2025, pending in the court of learned Chief Judicial Magistrate, Garhwa, stands rejected.
