JUDGMENT:
Case called out. There is no representation on behalf of the respondent.

2025:UHC:8422 2) This Court vide order dated 06.03.2024 has ordered as under :
“Mr. Ramji Srivastava and Mr. N.K. Adhikari,
learned counsel for the applicant.
2. A notice came to be issued by this Court vide
order dated 10.01.2025. The office note states that the postal authorities have returned the postal envelop with an endorsement that the respondent has refused to receive the same.
3. In that view of the matter, Registry is directed to print the name of the respondent in the cause-list.
4. List this matter on 21.03.2025.”
3) Despite the orders dated 06.03.2025 and 25.06.2025, there is no representation on behalf of the respondent.
4) Heard the learned counsel for the applicant.
5) The learned counsel takes the Court through Annexure-2, the agreement, and, in particular, takes the Court through paragraph 37 which refers to the settlement of disputes by arbitration. The learned counsel also takes the Court through Annexure-4, which is a notice issued in compliance of provisions of Section 21 of the Arbitration and Conciliation Act. 2

6) There is no denial of the assertions made on behalf of the applicant. This Court sees no ground not to allow the application.
7) Accordingly, the Arbitration Application is allowed.
8) Mr. Pramod Kumar Goel, Retired District Judge, R/o A-97, Sector-2, Shatabdi Nagar, Panchwati Road, Meerut – 250 103 (Uttar Pradesh) is appointed to act as an Arbitrator to adjudicate the disputes between the parties and to pass an order in accordance with law.
9) The Registry to communicate the order and secure the consent of the Arbitrator.
10) The Arbitrator shall, in terms of Section 11(8) of the Act, furnish his disclosure in writing to the Court within 15 days from the date of receipt of a certified copy of this order.
11) It is open for the parties to determine the rules and procedure of arbitration and the place of arbitration in consultation with the Arbitrator in terms of Sections 19 and 20 of the Act. The Arbitrator shall, in consultation with the parties, fix the remuneration and other 3
2025:UHC:8422 chargeable fees. The Arbitrator shall endeavour to hear and pass an Award within the time provided under the statute,
12) The arbitration application stands ordered accordingly.
