HPBOCW Welfare Board Outsource Employees Union vs. State of Himachal Pradesh and others CMP No. 11138 of 2025 in Ex. Petition No.1143 of 2024 26.06.2025 Present Mr. Amrick Singh, Advocate, for the petitioner. Mr. Anup Rattan, Advocate General with Mr. Rajan Kahol and Mr. B.C.Verma, Additional Advocate Generals and Mr. Ravi Chauhan, Deputy Advocate General, for respondent No.1. Mr. Rohan Tomar, Advocate, for respondent No.2. While placing on record communication dated 25.06.2025, issued under the signatures of Deputy Secretary (LE& OP) to the Government of Himachal Pradesh, Mr. Ravi Chauhan, learned Deputy Advocate General states that no separate reply is required to be filed and afore respondent may be permitted to adopt the reply filed by respondent No.2. Ordered accordingly. Careful perusal of reply filed by respondent No.2 reveals that in terms of the mandate contained in the judgment, sought to be executed in the instant proceedings, respondent No.2 after having considered the case of the petitioner in light of observations made in the judgment, sought to be executed and has passed consideration order. Moreover, this Court finds that judgment on the basis of which, consideration order was directed to be passed has been stayed by Hon'ble Apex Court. In view of above, nothing remains to be adjudicated in the instant proceedings and accordingly same are disposed of, reserving liberty to the petitioner to file appropriate proceedings in appropriate Court of law, laying therein challenge to the consideration order passed in purported compliance of the judgment, sought to be executed, if so advised.
