According to him, amount payable as leave encashment and dearness allowance has not been paid to him so far, therefore, by means of this writ petition, petitioner has sought a direction to the employer to clear his dues. (3) Mr. S.S. Chauhan, learned Counsel appearing for Uttarakhand Payjal Nigam, on instructions, submits that the entire amount payable as gratuity has been released to petitioner, however, due to financial crunch, the amount payable as leave encashment and dearness allowance could not be paid so far. He assures the Court that remaining payment would be made to petitioner as early as possible. (4) Writ petition is, accordingly, disposed of by directing the Managing Director, Uttarakhand Payjal Nigam to release entire admitted dues to petitioner within three months from the date of production of certified copy of this order.
