Neutral Citation No. - 2025:AHC-LKO:4691
Court No. - 14 Case :- HABEAS CORPUS WRIT PETITION No. - 24 of 2025 Petitioner :- Smt. Shivani Thru. Her Husband Anuj Kumar Respondent :- State Of U.P. Thru. Home Secy. Lko And 3 Others Counsel for Petitioner :- Azhar Ikram,Pawan Bhaskar Counsel for Respondent :- G.A. Hon'ble Mohd. Faiz Alam Khan,J.
1. Heard learned counsel for the petitioner as well as learned A.G.A. for the State and perused the record.
2. Written instructions submitted by the Police Station Auras, District Unnao has been placed before this Court for perusal and the same is taken on record.
3. Perusal of this instructions would reveal that the alleged detenue- Smt. Shivani was reported to be missing and in this regard a 'missing report' was lodged by her father- respondent no.2 and in pursuance of the same the Senior Inspector of Police Station Nayagaon, District Bhind, Madhya Pradesh had arrived and with the help of the police personnels of Police Station Auras, District Unnao the alleged detenue was recovered and at first she was kept in a one stop center Bhind and, thereafter, presented before a competent court and under the orders of that Court the detenue has been given in the custody of her father i.e. respondent no.2.
4. Thus, the custody of the alleged detenue- Smt. Shivani with her father i.e. respondent no.2/Radhey Shyam may not be deemed to be illegal as the same is under the specific orders of a court and if the petitioner feels aggrieved by the same he can approach any superior Court against the order where under the custody of the alleged detenue has been given to the respondent no.2- her father Shri Radhey Shyam.
5. Thus, the instant petition appears to have lost its efficacy and is dismissed as such. Order Date :- 24.1.2025 Praveen Digitally signed by :- PRAVEEN KUMAR High Court of Judicature at Allahabad, Lucknow Bench
