Jyotsna Rewal Dua, Judge Following was passed in the matter on 21.06.2025:-
“The respondents have not implemented the judgment in question. The judgment is based upon a decision rendered in CWP No.1638 of 2024 (Mohit Sharma & Anr. Versus State of H.P. & Ors.), decided on 29.11.2024. It is not in dispute that the decision in Mohit Sharma, supra, stands implemented. This otherwise is apparent from Annexure C-2, copy of an order passed on 08.04.2025 in Execution Petition No.79 of 2025, which goes as under:-
“Learned Deputy Advocate General has placed on record office instructions dated 07.04.2025. Mr. Anup Rattan, learned Advocate General, submits that a decision has been taken to implement the
judgment dated 29.11.2024, rendered in CWP No.1638 of 2024 (Mohit Sharma and Anr. Vs. State of H.P. & Ors). Learned Advocate General, however, seeks three weeks’ time for implementing the decision in case of present petitioners. In view of above statement, list this matter on 02.05.2025 for overseeing the compliance.”

Before passing any adverse order, final opportunity of a week is granted to the respondents to implement the decision. List on 27.06.2025.”

During the course of hearing today, learned Additional Advocate General has placed on record office instructions dated 26.06.2025 from the Director, School Education, Himachal Pradesh. As per office instructions, benefit of higher stage of pay in accordance with Pay Revision Rules has been extended to the petitioner by respondent No.2 subject to final outcome of legal remedy availed by the State. Copy of the consideration order dated 25.06.2025 has also been appended along with the office instructions.

Taking note of the above, present execution petition is disposed of with liberty to the petitioners to seek appropriate remedy for redressal of their surviving grievances, if any, in accordance with law, at an appropriate stage. Pending miscellaneous application(s), if any, also to stand disposed of.
