Parties are present before the National Lok Adalat and are duly identified by their counsels. This Appeal from Order, is arising out of an award dated 28.06.2014, as it was passed by the Motor Accident Claims Tribunal/ Second Addl. District Judge, Nainital District Nainital in MACP Case No.05 of 2021, ‘Nanda Ballabh Mishra Vs. Mahendra Singh’. Before the Lok Adalat, the parties have agreed to settle the matter and appellant has agreed to pay a sum of Rs.8,50,000/-, out of which, Rs.50,000/- cash has been handed over to claimant no.2/ Deepak Mishra, while a postdated Cheque No.288088 dated 13.10.2025 of Rs.1,35,000/- has been issued by the appellant. It is submitted that the deposited amount of Rs.6,40,000/-, which has been deposited before the Tribunal in compliance of interim order dated 08.01.2025 and the statutory amount of Rs.25,000/- deposited before this Court shall be remitted back to the concerned Tribunal. The terms of the compromise have been recorded in a separate compromise sheet. In such view of the matter, the appeal stands disposed of in terms of compromise entered into between the parties.
