Heard learned counsel for the petitioners and learned A.G.A., who appears for the State- respondent. This petition has been filed with the following main prayers ; "(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned First Information Report dated 14.01.2025 registered as FIR No.12 of 2025, under Sections 110, 115(2), 117 (2), 351(3), 352 of BNS at Police Station Jamo, District Amethi in respect to the petitioners. (ii) Issue a writ, order or direction in the nature of Mandamus directing the opposite parties not to arrest the petitioners in pursuance of the impugned First Information Report lodged as FIR No.12 of 2025, under Sections 110, 115(2), 117 (2), 351(3), 352 of BNS at Police Station Jamo, District Amethi." Learned A.G.A., on the basis of instructions sent by Shri Daljit Singh, Sub Inspector, Police Station Jamo, District Amethi, says that Section 109 of B.N.S. has been added during the course of investigation by the Investigating OfÏcer. At this stage, learned counsel for the petitioners submits that the writ petition may be dismissed as withdrawn. Accordingly, the writ petition is dismissed as withdrawn with liberty to the petitioners to file a fresh petition.
