It is argued that the written statement has not been filed by the three of the defendants. 4. In case, if the said statement is correct, the petitioner can move an appropriate application under Order 8 Rule 10 CPC. In case, if such application is filed, the same shall considered in accordance with law. 5. The present petition is disposed of.
