Heard learned counsel for the petitioners, learned Additional Chief Standing Counsel for the State and Shri Rakesh Kumar Yadav holding brief of Mrs. Neera Yadav, learned counsel for the opposite parties no. 3 and 4. The petitioners have filed this writ petition for removal of the electricity poles installed on their land bearing Gata No. 1399/1409 situated in Village - Gird Gonda Gramin, Pragana, Tehsil and District- Gonda. Learned counsel for the opposite parties says that the poles have been existing for the past 50 years as stated in Para 9 of the writ petition, but, learned counsel for the petitioners says that the petitioners are residing elsewhere and now, after retirement they propose to settle at the place where the electricity poles are there, therefore, the poles should be removed or if they are not to be removed, then, they should be maintained because they are in a condition where they may fall any time which will cause irreparable loss. Let the Official opposite parties look into the matter as regards the condition of the poles and do the needful. For other reliefs the petitioners may avail other remedies as may be prescribed in law. With the aforesaid observations/directions, the writ petition is disposed of. . (Brij Raj Singh,J.)
