GP FOR SOCIAL WELFARE The Court made the following ORDER: Heard Sri Mohd.Rafi, learned counsel representing Sri A.Syam Sundar Reddy, learned counsel for the petitioners and Sri Sk.Khaja Basha, learned standing counsel for the respondents 2 to 4. 2. The 1st petitioner is the President and 2nd petitioner is the Secretary of Shasha Peeran Mosque Committee situated at P.H.Road, Chittoor Town and District, filed the above writ petition complaining about non-consideration of the recommendation made by the 4th respondent-Inspector Auditor, Waqf Board, Chittoor to the CEO, A.P State Waqf Board vide F.No.34/IAW/CTR/2024, dated 24.12.2024, as illegal and arbitrary. 2 3. The 3rd respondent appointed the petitioners 1 and 2 as President and Secretary respectively and others as Vice-President etc., to Shasha Peeran Mosque Committee vide proceedings F.No.02-K/CTR/2009, dated 18.04.2022 for three (3) years. The Committee has been discharging duties without any remarks. The term of the Committee would be expiring by 17.04.2025. A request was made by way of representation dated 24.12.2024 (Ex.P.2) to extend the time of the Committee. The Inspector Auditor, Waqf Board, Chittoor District, recommended the existing Committee vide Ex.P.3. However, the A.P State Waqf Board has not passed any orders. 4. Learned standing counsel would submit that the CEO has to place the matter before the A.P State Wakf Board as per Rule 22 of the Andhra Wakfs Managing Committee (constitutions, functions and duties) Regulations, 2009. Learned counsel would also submit that Rule 22 of the Regulations, 2009, enables the Waqf Board to renew the Committee. 5. Thus, given the facts and circumstances of the case, without touching the merits of the matter, the writ petition is disposed of, at the admission stage with the consent of learned counsel on either side, directing the learned 3rd respondent to place the representation dated 24.12.2024 made by the petitioner along with relevant material before the A.P State Waqf Board, within four (4) weeks from the date of receipt of a copy of this order. Thereafter, the A.P State Waqf Board shall pass appropriate orders in terms of Section 18 of the Waqf Act, 1995 r/w Rule 22 of the Andhra Wakfs Managing Committee (Constitutions, Functions and Duties) Regulations, 2009 within four (4) weeks. No order as to costs.
