Present petition has been filed with the following relief: "(i) Issue a writ, order or direction in the nature of mandamus commanding to opposite party no.2 to 4 to take necessary action for removal of encroachment on the public utility land of Gata No.398/0.0490 h. is a composed pit & Gata No.406/0.6840 h. is the public path situated in village Kherva, H/o. Basara, Post Behjam, Tehsil Mitauli, Pargana Kheri, District Lakhimpur Kheri and take necessary action as provided under the U.P. Revenue Code, 2006." 2. Learned Standing Counsel, based upon instructions, states that the offending constructions have been removed. The instructions are taken on record. 3. In view thereof, no further relief can be granted. However, in case the petitioner is still aggrieved and demonstrates through evidence that any offending construction still exists, he may move an appropriate application under Section 67 of U.P. Revenue Code which shall be decided in accordance with law. 4. Present petition stands disposed off in above terms.
