This first bail application has been moved by the applicant seeking regular bail in F.I.R. No.120 of 2024, under Sections 2/3 of the Uttar Pradesh Gangsters and Anti- Social Activities (Prevention) Act, 1986, registered at Police Station Haldwani, District Nainital. 3. Learned counsel for the applicant submits that the applicant has been falsely implicated in the present case and has been languishing in judicial custody since 14.09.2023. It is further submitted that the applicant has been prosecuted under the provisions of the Gangster Act on the basis of multiple First Information Reports registered against him at different police stations across various districts, all arising out of identical facts and circumstances, under Sections 420, 409, and 120-B of the Indian Penal Code as well as Section 3 of the Uttarakhand Protection of Interests of Depositors (in Financial Establishments) Act, 2005. Learned counsel contends that the applicant has already been enlarged on bail in each of the aforesaid cases. 4. Learned State Counsel does not controvert the submission that the applicant has been granted bail in all the aforementioned matters. 5. Considering the submission of learned counsel for the parties and without expressing any opinion as to the final merits 2025:UHC:9389 of the case, this Court is of the view that applicant deserves bail at this stage. 6. The bail application is allowed. 7. Let the applicant, namely, Manoj Singh Negi be released on bail, on executing personal bond and furnishing two reliable sureties, each of like amount, to the satisfaction of Court concerned.
