Neutral Citation No. - 2025:AHC-LKO:5118 Court No. - 6 Case :- WRIT - A No. - 891 of 2025 Petitioner :- Vinod Kumar Respondent :- State Of U.P. Thru. Addl. Chief Secy./ Prin. Secy. Basic Edu. Lko. And 3 Others Counsel for Petitioner :- Mayankar Singh Counsel for Respondent :- C.S.C.,Ran Vijay Singh Hon'ble Alok Mathur,J.
1. Heard Sri Mayankar Singh, learned counsel for petitioner as well as learned Standing Counsel for the State. 2. It has been submitted by learned counsel for petitioner that petitioner is working as a Block Education Officer under Basic Education Officer, Bareilli and by means of order dated 30.06.2024 he has been transferred from district Bareilly to District Itah. 3. The petitioner has assailed the said transfer order on various grounds by means of representation addressed to the Director of Education (Basic), Prayagraj i.e. respondent no. 2. 4. He has further submitted that the petitioner has been relieved on 16.12.2024 by the District Basic Education Education Officer but till date he has not joined at his transferred place of posting and in the present case, the transfer order has been assailed. 5. After arguing the matter at some length, learned counsel for petitioner submits that grievance of the petitioner shall be substantially redressed in case respondent No. 2 is directed to consider and decide the representation of the petitioner dated 09.01.2025 (Annexure No. 8) in a time bound manner. 6. Learned Standing Counsel does not object if a direction is issued to respondent for expeditious disposal of the representation preferred by the petitioner. 7. Accordingly, considering that in pursuance of transfer order dated 30.06.2024, the petitioner has already been relieved on 16.12.2024, this Court finds no justification for his not joining at transferred place of posting merely on the fact that representation given by him are pending. 8. In light of the above and considering the fact the representation has already been made by the petitioner, it is provided that in case petitioner joins at transferred place of posting within seven days from today, respondent No. 2 shall proceed to consider and decide the representation of the petitioner dated 09.01.2025 (Annexur No. 8), expeditiously, say, within a period of three weeks from the date of joining of the petitioner in accordance with law and communicate the decision to the petitioner. 8. With the aforesaid observations / directions, the writ petition stands disposed of.
