PUBLIC PROSECUTOR (AP) The Court made the following: 3 ORDER: The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) has been filed by the Petitioner/Accused No.4, seeking quashment of the proceedings pending against her in P.R.C.No.30 of 2017, on the file of Additional Junior Civil Judge, Chilakaluripet in Crime No.175 of 2017 of Chilakaluripet Town Police Station, Guntur District. 2. Heard Sri Chethan.T, learned counsel for the Petitioner/Accused No.4 and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State. 3. Learned counsel for the petitioner would submit that the petitioner has nothing to do with the present case. There are no specific overt acts in the complaint against the petitioner. Learned counsel would further submit that this Court in the similar circumstances, in Crl.P.No.12242 of 2018, quashed the proceedings initiated against the Accused Nos.2 and 3 in the same Crime Crime No.175 of 2017 vide orders dated 28.03.2023. Learned counsel for the petitioner finally prays to allow the petition, in terms thereof. 4. Learned Assistant Public Prosecutor fairly conceded that the case of the present petitioner is on the same footing as of the Accused Nos.2 and 3 against whom the criminal proceedings were quashed. She would further submit that the Court may pass appropriate orders. 4 5. The relevant portion of the order dated 28.03.2023 passed in Crl.P.No.12242 of 2018 is extracted hereunder: “09.All the Judgments cited by the learned counsel for the petitioners had gone into various facets of what would constitute abetment to suicide. One common thread is the requirement of intentionally pushing the deceased to commit suicide. Mere harassment would not amount to an offence under Section 306 of Indian Penal Code. 10. In that view of the matter, it must be held that the allegations in the charge-sheet do not make out any case of abetment by the petitioners, under Section 306 of Indian Penal Code and consequently, this Criminal Petition is allowed quashing P.R.C.No.30 of 2017 on the file of the Additional Junior Civil Judge at Chilakaluripet, Guntur District against the petitioners herein.” 6. Hence, for reasons alike, following the orders passed by this Court in Crl.P.No.12242 of 2018 dated 28.03.2023, and taking into consideration of the facts and circumstances of the case, this criminal petition is allowed, quashing the criminal proceedings pending against the petitioner/accused No.4 in P.R.C.No.30 of 2017 on the file of the Additional Junior Civil Judge at Chilakaluripet, Guntur District.
