Neutral Citation No. - 2025:AHC-LKO:5005 Court No. - 19 Case :- CIVIL MISC REVIEW APPLICATION No. - 12 of 2025 Applicant :- Sm. Jagdambey Opposite Party :- State Of U.P. Thru. Addl.Chief Secy. Revenue Deptt. Lko. And Others Counsel for Applicant :- Girish Datt Pandey,Nripendra Mishra,Ram Sahay Yadav Hon'ble Manish Mathur,J. Heard learned counsel for applicant. In view of order being passed, notice to opposite parties stands dispensed with. Review application against judgment and order dated 20.12.2024 in Writ-C No. 11364 of 2024 has been preferred.
Learned counsel for applicant submits that after passing of
judgment and order dated 20.12.2024, the Government itself has issued the order dated 26.12.2024 indicating that in case a person is ready to deposit the stamp deficiency alongwith interest, the case should be closed without adverting to penalty. It is submitted that since applicant wants to settle his case in terms of Government Order dated 26.12.2024, the order impugned requires to be revisited. Considering submission advanced by learned counsel for applicant and upon perusal of material on record, it is quite evident that Government Order dated 26.12.2024 relied upon has been passed subsequent judgment under challenge and therefore would not denote an error apparent on the face of record since such subsequent happenings cannot be material for reviews of judgment which has been passed prior thereto. In view of aforesaid, the review application being devoid of merit is dismissed.
