Baruah, the learned Additional Public Prosecutor appearing for the State of Assam, who submits that the Case Diary has not yet been Page No.# 2/2 received. 2. He further submits that the reason for not receiving the Case Diary may perhaps be the fact that earlier this case was investigated on the basis of a G.D. Entry and later on, North Lakhimpur P.S. Case No. 119/2024 was registered. 3. However, he fairly submits that the Investigating Officer has not intimated to the Office of the Public Prosecutor the reason for not sending the Case Diary. It appears that this case has been pending for more than 1(one) year. Moreover, considering the submissions made by the learned counsel for the petitioner that the petitioner was granted interim bail and in pursuant to the directions of this Court, he has appeared before the Investigating Officer and has co-operated in the investigation, the interim bail granted to the petitioner, namely, Ranjan Pegu, by order dated 24.05.2024 is hereby made absolute with a condition that he shall continue to co-operate in the investigation. 4. Send back the Case Diary. 5. This anticipatory bail application is accordingly disposed of. JUDGE Comparing Assistant
