The instant application under Section 483 Cr.P.C. has been preferred for the following main relief:- "Wherefore, it is most respectfully prayed that this Hon,ble Court that this Hon,ble Court may Kindly be pleased to direct the trail court i.e. Chief Judicial Magisrate, Court No.16, Sultanpur, to expedite and early decided the application under section 320 (1) and (2) Cr.pc. / u/s 359 B.N.S. S pending in of Criminal Case No. 9841/ 2022, State versus Madhuri under section 504,506,406, I.P.C. u/s 352,351(2)/3,316(2) B.N.S Police Station kotwali Nagar, Sultanpur, with in some stipulated time as directed by this Hon, ble Court in the interest of justice or pass any other order as deem fit and, proper under the circumstances of the case and in the interest of justice." Considering the facts as indicated in the instant application including that a civil suit filed by opposite party no.2/informant i.e. Civil Suit No. 551 of 2023 (Jagdish Prasad Versus Madhuri Devi) for recovery of amount to the tune of Rs. 77,50,000/- filed impleading the applicant as a defendant, has already been decreed in terms of compromise in exercise of power under Order 23 Rule 3 CPC and the proceedings of the Execution Case No. 9 of 2024 (Jagdish Prasad Versus Madhuri Devi) have also been concluded as would appear from the order dated 18.07.2024, annexed as Annexure No.7 to the present application, the instant application is disposed of with direction to the trial court to dispose of the application dated 14.11.2024 preferred under Section 359 BNSS, most expeditiously, as per law.
