Yusuf Ali, learned advocate appears for the petitioner. None appears for the alleged contemnor. The petitioner submits that, this is a contempt proceeding arising from the order dated September 26, 2024. The alleged contemnor had held the necessary inspection of the alleged unauthorized construction on March 28, 2025 in presence of the petitioner and all other concerned parties. Hearing had taken place on April 16, 2025 and reasoned order has been passed holding the alleged construction being unauthorized. The petitioner has been served with a copy of the reasoned order dated April 16, 2025 which is placed before this 2 Court by the petitioner, the same is taken on record. The only allegation is that the inspection report has not been served upon the petitioner. In view of the above, this Court is of the considered view that, the direction of this Court dated September 26, 2024 stands complied with. In the event the petitioner applies before the alleged contemnor for a copy of the joint inspection report, the same shall be provided to the petitioner by the alleged contemnor positively within a period of three days from the date of receiving the application. The petitioner shall also be at liberty to serve a copy of the reasoned order upon the jurisdictional Sub- Divisional Officer. In view of the above nothing further remains to be adjudicated in this contempt proceeding. Accordingly CPAN 340 of 2025 stands dropped and closed. The application CPAN 340 of 2025 stands disposed of, without any order as to costs. (Aniruddha Roy, J.)
