And 3 Others Counsel for Applicant :- Vikas Chauhan Counsel for Opposite Party :- G.A. Hon'ble Karunesh Singh Pawar,J. Heard learned counsel for the petitioner and learned AGA for the State. Notices to respondent no. 2 are dispensed with in view of the proposed order. By this petition, the petitioner has prayed for the following relief:- "It is, therefore, most respectfully prayed that this Hon'ble Court be pleased to allow this application, set aside/quash the Criminal Complaint pending in the court of special Judge (POCSO ACT)/Additional Session Judge, court no.14, District Sitapur as Criminal Case No. 19/2022 under section 363,376-D I.P.C.3/4 Pocso Act of P.S. Biswan, Dist- Sitapur." Perused the record. Perusal of the impugned summoning order dated 08.08.2023 shows that the same has been passed after going through the statements of the complainant and the witnesses recorded under Section 200 and 202 Cr.P.C. Learned magistrate has passed the impugned summoning order after finding prima facie commission of offence. No ground has been raised by the petitioner to press this petition. There appears to be no illegality in the impugned summoning order. The petition is devoid of merits and is accordingly dismissed. Order Date :- 22.1.2025 R.C.
