Heard learned counsel for the petitioner as well as learned counsel for the opposite party. 2. Instant transfer petition has been preferred to for transfer of Original Suit No. 51 of 2025 from the Court of learned Principal Judge, Family Court, Gooda to the Court of learned Principal Judge, Family Court, Sahibganj. 3. Learned counsel for the petitioner has submitted that the marriage of the petitioner was solemnized on 19.11.2022 as per Hindu Rites and Customs and the petitioner and respondent had been living together as wife and husband at the matrimonial home at village- Bara Simra, District-Godda. During the stay of the petitioner at the matrimonial house, the petitioner was subjected to torture and cruelty in connection with the demand of additional dowry. Further, petitioner had filed a written report against the respondent (husband) and the relatives of the respondent on 18.03.2025 before the officer-in-charge and the notices have been issued upon the respondent and his family members, resultantly, the petitioner has been ousted from her matrimonial house and is residing at her maternal home with her one and half years girl child and being taken care of her livelihood by her parents. Therefore, the petitioner has poor 2025:JHHC:16475 financial status having no other source of income and her dependent baby girl is unable to travel to Godda to attend the Court proceedings in connection with Original Suit No. 51 of 2025 which is pending before learned Principal Judge, Family Court Godda. Therefore, it is humbly submitted that the case may be transferred from the Court of learned Principal Judge, Family Court, Godda to the learned Court of Principal Judge, Family Court, Sahibganj. 4. On the other hand, learned counsel for the respondent has raised no serious objection in this regard. 5. Considering the facts and circumstances and the submission made on behalf of the parties, I feel inclined, in the ends of justice, to allow the prayer for the petitioner. 6. Accordingly, the proceeding of Original Matrimonial Suit No. 51 of 2025, pending before the Court of Court of learned Principal Judge, Family Court, Godda is hereby transferred to the learned Court of Principal Judge, Family Court, Sahibganj. 7. Accordingly, the present transfer petition is allowed. 8. Learned trial court, Sahibganj has to proceed with the trial of the case being Original Matrimonial Suit No. 51 of 2025 expeditiously in accordance with law without granting unnecessary adjournment(s) to any of the parties..
