Heard learned counsel for the petitioner as well as learned A.G.A. for the State and perused the record. This petition has been moved with prayer to issue an appropriate order or direction to learned Civil Judge, Hawali (Junior Division), Lucknow to expeditiously decide/dispose of the application bearing Misc. Case No.513/2024 filed by the petitioner under Section 340 Cr.P.C. in Regular Suit No.242/2023 within stipulated time frame. It is submitted by learned counsel for the petitioner that in this case an application u/s 340 Cr.P.C. was moved before the court of learned Civil Judge, Hawali (Junior Division), Lucknow which was registered as Misc. Case No.513/2024 but is still pending and no endeavour is being made by the learned Presiding Officer to dispose of the application, therefore, request to direct the learned court concerned to decide the aforesaid application within stipulated period of time. Learned A.G.A. has no objection in this regard. Considering the facts and circumstances of the case, submissions made by learned counsel for the petitioner as well as learned A.G.A. and the order sheet annexed, it is expedient to direct the learned court concerned to make endeavour to decide the aforesaid application u/s 340 Cr.P.C. pending before the learned court of Civil Judge, Hawali (Junior Division), Lucknow preferably within a period of 60 days, in accordance with law.
