Neutral Citation No. - 2025:AHC-LKO:22173-DB Court No. - 10 Case :- CRIMINAL MISC. WRIT PETITION No. - 567 of 2025 Petitioner :- Kumar Abhinav Raj And 3 Others Respondent :- State Of U.P. Thru. Prin. Secy. Home Deptt. Lko. And 3 Others Counsel for Petitioner :- Niteesh Kumar,Vineet Kumar Verma Counsel for Respondent :- G.A.,Rajeev Narayan Pandey,Sharvan Kumar Yadav Hon'ble Vivek Chaudhary,J. Hon'ble Ram Manohar Narayan Mishra,J. Heard learned counsel for the petitioners, learned A.G.A. as well as Sri Sharvan Kumar Yadav, learned counsel for opposite party no.4 and perused the record. The report of the Senior Registrar of this Court dated 25.03.2025 is on record, according to which he has verified the compromise on 25.03.2025. The original compromise is on record which has been annexed as Annexure No.2 to the writ petition.
Learned counsel for the parties also state that the parties have settled their dispute amicably and submitted their deed of compromise which has been duly verified by the Senior Registrar of this Court. The opposite party no.4/informant has filed a supplementary affidavit dated 15.04.2025, stating therein that he does not want to prosecute rest of the accused persons against whom the F.I.R. was lodged but they are not petitioners in the present writ petition as the informant has already received his money and now he has no claim against them also. According to the terms of the compromise, parties have decided to withdraw all the cases filed by them against each other including First Information Report dated 27.05.2023 bearing Case Crime No.0219 of 2023, under Sections 506,504,471,468,467,420,419,406 I.P.C., Police Station Chinhat, District Lucknow. Intent is clear, the informant - Sri Devendra Singh, who is a signatory to the compromise, does not want to press the FIR, therefore, no purpose would be served in allowing the
proceedings even if charge sheet has been filed before the court below to go on considering nature of the dispute. Accordingly, the impugned FIR, which is the basis to serve consequential proceedings of investigation and thereafter filing of charge sheet, if any, is hereby quashed. Consequently, all proceedings taken consequent to lodging of the FIR including charge sheet, if any, filed before the court below stand quashed. The writ petition is, accordingly, allowed. The Senior Registrar of this Court shall communicate this order to the court concerned for correcting its record, accordingly. Learned AGA shall communicate this order to the investigating officer.
