PUBLIC PROSECUTOR The court made the following Order: This Criminal Petition, under Sections 480 and 483 of the BNSS, has been filed by the petitioner/A3, seeking regular bail, in Crime No.252 of 2024 of Sabbavaram Police Station, registered for the offence punishable under Section 20(b)(ii)(C), 25 read with 8(c) of the NDPS Act. 2. Case of the prosecution, in brief, on 01.12.2024, on receipt of credible information, the Sub-Inspector of police along with his staff and mediators rushed to BT road leading from Chodavaram to Sabbavaram, and caught the accused in possession of 167Kgs of Ganja. The contraband along with other material was seized under the cover of mediators report. 2 3. Heard. Perused the record. 4. Learned counsel for the petitioner contends that the petitioner has been in judicial custody from 01.12.2024 and prays to grant bail to the petitioner herein. 5. On the other hand, learned Assistant Public Prosecutor opposed to grant bail on the ground that contraband allegedly involved in the present crime is 167Kgs of Ganja, which is a commercial quantity. 6. In view of the gravity of offence and involvement of commercial quantity of ganja and in view of the bar contained under Section 37 of the NDPS Act, this Court is not inclined to grant bail to the petitioner. 7.
