This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioner apprehending his arrest in connection with R.A. Case No.101 of 2025, for offences under Sections 3(a) R.P.(U.P.) Act. The case is presently pending before the Court of learned Railway Magistrate, Chakradharpur at Chaibasa.

At the very outset, learned CGC representing the Union of India, after going through the case diary submits that Process under Section 82 Cr.P.C. has been issued against the petitioner and the same has been executed on 24.05.2025. Further, it is submitted that there are two other criminal cases pending against the petitioner of similar nature.

Since the Process under Section 82 Cr.P.C. has been issued, this Anticipatory Bail Application is not maintainable as per the judgment of the Hon’ble Supreme Court.

Accordingly, this Anticipatory Bail Application stands dismissed being not maintainable.
