Neutral Citation No. - 2025:AHC-LKO:5489-DB Court No. - 1 Case :- WRIT - C No. - 606 of 2025 Petitioner :- Smt. Ruchi Seth Respondent :- Dist. Magistrate / Collector Lko And 4 Others Counsel for Petitioner :- Anoop Kumar Srivastava Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard Sri Anoop Kumar Srivastava, the learned counsel for the petitioner, Sri Manish Kumar Mishra, the learned Standing Counsel appearing on behalf of the State and perused the records.
2. The learned counsel for the State pointed out that the property in question was acquired with issuance of notifications under Sections 4 and 6 of the Land Acquisition Act way back in the year 2007 and 2008 respectively, the award thereof was also rendered on 28.09.2010 and the possession of land in dispute was handed over on
26.09.2015.
3. All these events clearly indicate that the original tenure holder stood divested of his title in the property which the petitioner has claimed on the basis of a sale deed executed in her favour in the year 2019. Once no title vested in the original tenure holder, any transaction executed by him after acquisition proceedings has no sanctity in the eyes of law.
4. In these circumstances, the prayer for compliance of the mutation order passed by Revenue Authorities on 28.09.2019 has no consequence. The writ petition being bereft of merit is dismissed.
