Counter affidavit filed today by the State counsel is taken on record. Heard learned counsel for the applicant, learned A.G.A. for the State and perused the material placed on record. The present anticipatory bail application under Section 482 BNSS has been filed seeking anticipatory bail in case crime No. 456 of 2024, under Sections 319(2), 318(4), 338, 336(3), 340(2) B.N.S., P.S. Laharpur, District- Sitapur. From perusal of the record as well as the FIR, it transpires that the allegation of impersonation is against the applicant and it has been submitted by the counsel for the applicant that on the false promise, she was taken by some other persons for getting available her the benefit of some government scheme and on place of the same, she was produced before the Registrar of registry office and some fraud is committed by someone else and as such, she was not involved in committing the offence, though he has failed to substantiate the arguments by way of any evidence. Learned counsel for the applicant has also failed to satisfactorily substantiate that the applicant would not tamper the evidences and would not threaten the witnesses. Apprehension of arrest has also been denied. Considering the complicity of the accused-applicant and looking into the gravity of nature of offence, this Court does not find any good ground to intervene in this matter. The anticipatory bail application of the applicant, Smt. Sunita is hereby rejected.
