This Criminal PetitI'Ofi, under Sections 480 & .483 of the Bharatl'ya NagarI'k Suraksha Sanhita, 2023, has been filed by the_petitioner/A.1, seeking regular bail, in Crime No.539 of 2024 of Sarpavaram Police Station, Kakinada District. 2. A case has been registered against the petitioner and others for the offence punishable under Section 8(c) I/w 20(b)(ii)(C) of NDPS Act. 3. Case of the prosecution, in brief, is that, on o7.ll.2024 at about 6.00 a.m., on receipt of credible informatl'on regarding I'IIegal possession and transportation of ganja, the s.I. of police, Sarpavaram police station along with staff and mediators, started conducting vehicle checking at drainage canal bund, near dumping yeard, Ramanayyapeta, Kakinada Rural Mandal and observed two persons on suspicious circumstances. on I'nterrOgatiOn, they dI-SCIosed their identity particulars as that of A.1 and A.2 and police found 21 Kgs. ofganja in theI®r POSSeSSI-On. On enqul-ry, A.1 and A.2 confessed that they fetched the same from A.3 and A.4. Poll-Ce Seized the contraband and arrested the accused and got them remanded to judicial custody on the same day. 4.
Heard learned counsel for the petitioner/A.2 and the learned Assistant Public Prosecutor representing the respondent/state. perused the record. 5. Learned counsel for the petitioner/A.1 contends that the case against the present petitioner and A.2 stands on the same footing and A.2 was t-- -a E=
I.al already released on bail as per the Orders Of this Court passed in Cr'lminal petition No.1029 of 2005 dated 10.02.2025, and prays that the Petitioner also be enlarged on bail. 6. Learned Assistant Public Prosecutor opposed tO grant bail to the petitioner. 7. After careful observation of the material On record and SubmiSSiOnS made on behalf of both sides, it shows that On 07.ll.2024, A.1 and A,2 were found in possession of 21 Kgs. of ganja in two POlythene covers. This Court, while granting bail to A.2, observed that Out Of 21 Kgs. of ganja, the polythene cover seized from the possession of A.2 contained 10 Kgs. of ganja and the other accused i.e. A.1 found to be in possession Of ll Kgs. of ganja. As the case of the petitioner stands on the same footing as that of A.2, who was granted bail, this court is constrained to allow the application Of the Petitioner on the same terms and conditions imposed on A.2. 8. ln the result, the Criminal Petition iS allowed with the following conditions: (i) The petitioner/A.1 shall be released on bail On his executing a personal bond for Rs.10,000/-(Rupees Ten thousand Only) With two sureties for a like sum each to the satisfaction of the learned special Judge for trial of cases under NDPS Act-Gum-I Additional sessions Judge, East Godavari District at Rajamahendravaram; (ii) on release, the petitioner shall appear before the Station House Officer concerned Once in a Week i,e.
