-versus-
Micro and Small Enterprises Facilitation Council, Odisha, Cuttack & Anr. …. Opposite Parties
CORAM:
DR. JUSTICE S.K. PANIGRAHI
Order No.
ORDER 28.03.2025
01.
1. This matter is taken up through hybrid arrangement.
2. Heard learned counsels for the Parties.
3. In filing this Writ Petition, the Petitioner-Company being represented through its Director, has challenged the order dated 30.01.2024/Annexure-12 passed in MSEFC Case No.34 of 2019.
4. Challenging the impugned order dated 30.01.2024,
learned counsel for the Petitioner submits that the case
was listed almost after three years from the date of its last listing. He further contends that since the matter was listed suddenly after three years, the Petitioner on the same date itself i.e. on 30.01.2024 though filed a time petition, the said petition was not entertained and accordingly, rejected.
5. Learned counsel for the Petitioner further submits that at the time of passing of the impugned order the Petitioner has not been given adequate opportunity of hearing to put-forth his case. He, accordingly, prays for allowing the prayer made in this Writ Petition.
6. Considering the submission made on behalf of the Petitioner and looking to the factual scenario of the case, this Court without expressing any opinion on the merits of the case of the Petitioner, sets aside the impugned
order dated 30.01.2024/Annexure-12 passed in MSEFC Case No.34 of 2019 and remits the matter back to the Director of Industries-cum-Chairman, MSEFC, Industries, Directorate, Odisha for re-adjudication of the same after giving adequate opportunity of hearing to the parties concerned.
7. The entire exercise shall be completed within a period of three months from the date of presentation of an authenticated copy of this order.
8. This Writ Petition is, accordingly, disposed of.
