Neutral Citation No. - 2025:AHC-LKO:4034 Court No. - 8 Case :- MATTERS UNDER ARTICLE 227 No. - 277 of 2025 Petitioner :- Ramkaran And Another Respondent :- Addl. Commissioner Administration Ayodhya Div. Ayodhya And 3 Others Counsel for Petitioner :- Ajay Kumar Pandey Counsel for Respondent :- C.S.C.,Mohan Singh Hon'ble Jaspreet Singh,J. Heard learned counsel for the petitioners. Notice on behalf of respondent nos.1 and 4 has been accepted by the office of Chief Standing counsel. Sri Mohan Singh learned counsel has accepted notice on behalf of respondent Gaon Sabha. In view of the order proposed to be passed by this Court, notice to the private-respondent No.2 is dispensed with. The petitioner has also approached this Court with the limited prayer that judgment and order dated 24.07.2024 passed in proceedings under Section 116 of the U.P. Revenue Code, 2006 has been assailed by the petitioners by filing an appeal which is engaging the attention of the respondent no.1. It is urged that the appeal was filed along with an application for interim relief on 22.08.2024. The private respondent has already put in appearance before the first appellate court on caveat. However, several dates have been fixed neither the appeal has been admitted nor the application for interim relief has been considered and in such circumstances, it is urged that the court may pass some expedite
order. Having considered the aforesaid submissions and from a perusal of the material on record, this Court is of the opinion that no gainful purpose would be served in keeping the writ petition pending rather ends of justice can be met by directing the respondent no.1/Additional Commissioner (Administration), Ayodhya to consider the appeal preferred by the petitioners for admission and simultaneously also take note of application for interim relief and after affording full opportunity of hearing to the parties, the application for interim relief may be decided. It is made clear that the court has not examined the case of the either of parties on merit and the court concerned shall decide
the application as well as the issue of admission of the appeal as expeditiously as possible. With the aforesaid, the petition is disposed of.
