[2025:RJ-JP:27999] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Criminal Miscellaneous Bail Application No. 3920/2025 Rajendra Kumar @ Thakur S/o Rameshwarlal, Aged About 30 Years, R/o Narsas, Police Station Nechwa, District Sikar (Rajasthan) (At Present Accused Confined In District Jail Sikar) ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Amit Singh Shekhawat For Respondent(s) For Complainant(s) : : Mr. Jaiprakash Tiwari, PP Mr. Gavendra Singh Chauhan HON'BLE MR. JUSTICE PRAMIL KUMAR MATHUR Order 25/07/2025 1. The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.0236/2024 registered at Police Station-Nechwa, District-Sikar for offences under Sections 189(2), 103(1), 324(4), 324(5) and 351(2) of BNS. 2. Heard learned counsel for the petitioner, learned Public Prosecutor as well as counsel for the complainant and perused the material available on record. 3. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that no specific act was attributed to the present petitioner. It is stated that the deceased was not taken to the Hospital in time, therefore the deceased succumbed to death. This is the case of no eye witness even the PW.1-father of the victim in his cross examination admits that he has mentioned the name of the [2025:RJ-JP:27999] (2 of 2) [CRLMB-3920/2025] present petitioner on the narration of the Police personnel. He further submits that the petitioner is behind the Bar since 17.11.2024 and charge-sheet has been filed. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioner in further custody, hence the bail application of the petitioner may be allowed. 4. On the contrary, learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application and stated that this is a case of honour killing. The petitioner has been named in the FIR and all the witnesses clearly stated the involvement of the present petitioner in the incident. 5. As marshelling of the evidence is not warranted at this stage, therefore, on consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially in backdrop of gravity and nature of the offence, but without expressing any opinion on the merits/demerits of the case, I am not inclined to grant benefit of bail to the petitioner. 6. Accordingly, the bail application under Section 483 B.N.S.S. is dismissed. (PRAMIL KUMAR MATHUR),J Sunita/46
