Neutral Citation No. - 2025:AHC:13549 Court No. - 5 Case :- WRIT - A No. - 1132 of 2025 Petitioner :- Raheemun Nisha Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Shrawan Kumar Tripathi Counsel for Respondent :- Anand Kumar Srivastava,C.S.C. Hon'ble Ajay Bhanot,J. Heard Shri Shrawan Kumar Tripathi, learned counsel for the petitioner, learned Standing Counsel for the respondents No.1, 2-State and Shri Anand Kumar Srivastava, learned counsel for the respondents No.3 and 4. The petitioner claims that he is entitled for appointment on compassionate ground. She has made an application in this regard before the competent authority but to no avail. Learned Standing Counsel for the respondents No.1, 2- State and Shri Anand Kumar Srivastava, learned counsel for the respondents No.3 and 4 submit that the matter requires factual determination as per applicable law by the competent authority in the first instance. However, they fairly contend that the claim of the petitioner regarding appointment on compassionate ground is liable to be decided by the competent authority in an expeditious time frame. In the wake of the preceding discussion and without going into the merits of the case, the respondent No.4-Executive Officer, Nagar Palika Parishad, Basti is directed to decide the application of the petitioner for appointment on compassionate ground as per law within a period of three months from the date of receipt of a certified copy of this order along with a fresh copy of application. With the aforesaid direction, the writ petition is finally disposed of.
