The present petition has been filed by the petitioner with the following prayer: "(1) Issue a writ, order or direction in the nature of mandamus commanding to the opposite parties specially opposite party no. 3 and 4to take necessary action for removal of encroachment of the Gata no. 476/0.4330 (Naveen Parati) i.e. public utility land of villagers situated in Village- Madhavapur, Pargana Tulsipur, Tahsil- Bhinga, District- Shrawasti and further be pleased to direct to the opposite party no. 7 to 12 to remove the encroachment from the public utility land situated in Village-Madhavapur, Pargana Tulsipur, Tahsil- Bhinga, District- Shrawasti in the interest of justice As Annexure No. 1." 3. Learned Standing Counsel based upon the instructions states that the proceedings under Section 67 of the U.P. Revenue Code are pending. 4. In view of the said statement, the present petition is disposed of with direction to conclude the said proceedings expeditiously within the time as prescribed in the statutes.
