A case has been registered against the Petitioner herein for the offences punishable under sect-Ions 115(2) and 109(1) read with 3(5) of the BNS. 3. The case of the PrOSeCut-Ion, in brief, iS that On o2.03.2025, the defactO COmPla®lnant filed a report before the police stating that he was previously acquainted with A1, and that Al and his elder brother Were known tO frequently get into quarrels with the public. They had asked the defaCtO complainant to join them, but he refused. On 02.03.2025, at around o6:00 p.m., the defaCtO COmPlainant Went tO Gopi Kr-lshna Bar and Restaurant at Gujjanagundla, Guntur, to ``- , >j tsfc.- 2 + consume alcohol... Al was also present there. The defacto complainant noticed that Al called him, but he did not go to him. In anger, Al assaulted the defacto complainant and that subsequently all the accused attacked the defacto complainant with sticks, targetl'ng hI'S head and body with an l'ntentiOn tO kill hl'm, resulting whl'ch, the defacto complainant sustained severe bleeding injuries. 4. Heard. Perused the record. 5. Learned counsel for the petl'tioner contends that except the offence under Section 109(1) of BNS, the other offence is punishable with less than seven years of imprisonment and Section 109(1) of the BNS is only added with a view to deprive the benefit of Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023 notice, as such, he requested this Court to enlarge the petitioner on anticipatory bail. 6. On the other hand, learned Assistant Public Prosecutor opposed to grant anticipatory bail to the petitioner herein and place the wound certl'ficate of the victim, wherein, it shows that the inJ'urieS Sustained by the victim are simple in nature. 7. A perusal of the material on record goes to showthatthe allegations mentI'Oned in the First Information Report does not fit to the inJ-urieS found in the wound certificate and the possibility Of making such allegations to attract an offence under Section 109(1) of BNS cannot be ruled out. It is submitted by the learned counsel for the petitioner that the victim did not admit in the hospital and received treatment as an out-patient. lt is submitted by the learned counsel for the petitioner that the petitioner herein has permanent abode and there is no =TE- oE=l .zj; z, POSSibility Of his fleeing away from the justice. lt is submI'tted by the learned Assl®stant Public Prosecutor that the investl'gatl'on in the present crime is completed and the charge sheet is not yet filed. 8. ln view of the aforesaI-d facts and Circumstances, this Court is inclined to grant anticl'patory bail to the petitioner herein on the following conditions. I') The petitioner herein/ Accused No.3 is directed to surrender before the Statl'on House Officer, concerned, within a Period Of two (2) weeks from today. on such surrender, Petitioner herein/A3 is ordered to be enlarged on bail on his executing a personal bond for Rs.25,000/- (Rupees twenty five thousand only) each wl'th two sureties for the like sum each to the satisfaction of the station House Officer, concerned. ii) On release, the petitioner herel'n/ Accused No.3 shall appear before the station House Officer, concerned, once in a week i.e., on every sunday between 10.00 AM and 01.00 PM for a period of two (2) months. iii) The petitioner herein/ Accused No.3 shall make himself available for investigation as and when required and that he shall not cause any threat, inducement or promise to the prosecution witnesses. Consequently, miscellaneous applications pending, if any, shall stand closed.
