ORDER: No representation for petitioner.
2. This revision was filed against the order of consolidated C.C.No.24 of 2002, C.C.No.166 of 2002 and C.C.No.148 of 2006 on the file of Additional Judicial Magistrate of First Class, Narsapur.
3. As on the date of filing of the revision, the revisionist age was shown as 85 years. As seen from eCourts, C.C.No.24 of 2002 was dismissed on
27.08.2019. The order of the learned trial Court is extracted as under:
“Complainant called absent. No representation. The SHO, Narsapur town police station filed memo along with death certificate of A2. Previously the counsel for A2 also filed memo before this Court stating that A2 died. Today police filed DC. Hence, in view of the death of A2, the case against A2 is abated. The case against A1 is dismissed on 04.02.2014. The case against A3 is dismissed on 11.12.2013. The present complaint is filed by the complainant against A1 to A3 only. Hence, in view of dismissal of case against A1, A3 and in view of death of A2, this complaint is dismissed under Section 256 Cr.P.C”.
4. As per the above order the petitioner Pendyala Lakshmi Narasimha Murthy/A2 died. Therefore, the learned trial Court abated the case against A2 in C.C.No.24 of 2002.
5. In view of dismissal of C.C.No.24 of 2002, nothing remains in this revision. Therefore, the Criminal Revision Case is dismissed as infructuous. No order as to costs.
