The applicant has preferred this Second Bail Application under Section 483 of BNSS, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 323/2023, registered 2 at Police Station Khairagarh, District-Khairagarh-Chhuikhadan- Gandai (C.G.) for the offence punishable under Section 302 of IPC. 2. The prosecution story in brief, is that, on 15.07.2023 the applicant assaulted her sister with the Tangiya, resulting to which her sister got severe injuries and died on the spot, therefore the police has registered the crime and arrested her. The first bail application was dismissed as withdrawn vide order dated 22.01.2025 but there is no progress in the trial and the prosecution is causing unnecessary delay. 3. It was argued by the learned counsel for the applicant that the applicant has been falsely implicated in this case. The applicant is in jail since 18.07.2023, charge sheet has been filed and conclusion of the trial will take some time. Therefore, he prays for grant of bail to the applicant. 4. On the other hand, learned State Counsel opposes the bail application and submits that all the evidences are against the applicant. 5. I have heard learned counsel for the parties and perused the case diary. 6. Considering the facts & circumstances of the case, nature & gravity of the offence, material available in the case dairy, this Court is of the opinion that it is not a fit case to enlarge the 3 applicant on regular bail. Accordingly, the bail application of applicant- Ku. Gayatri @ Rani Dhurve involved in Crime No. 323/2023 under Section 302 of IPC at Police Station- Khairagarh, District- Khairagarh-Chhuikhadan-Gandai, Chhattisgarh, is rejected. 7. However, this Court hopes and trusts that the Trial Court shall make earnest endeavour to conclude the trial expeditiously as soon as possible in accordance with law, if there is no legal impediment. 8.
