The learned counsel appearing for the petitioner submits that the petitioner has received a notice under Section 35 of the BNS. However, the petitioner is repeatedly asked to come to the police station for the investigation, which was registered in the month of October 2024.
2. It is submitted that the petitioner underwent a major bypass surgery on 14.07.2024 and has also filed copies of the discharge summary. It is also submitted that the Station House Officer, Repalle Police Station, Bapatla District, is detaining the petitioner without conducting any enquiry.

3. Accordingly, this Criminal Petition is disposed off. It is made clear to the Station House Officer, Repalle Police Station, Bapatla District, to conduct the investigation in accordance with the provisions as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
As a sequel, pending miscellaneous petitions, if any, shall stand closed.
