The present petition has been filed with the following prayer(s) : (i). issue a writ, order or direction in the nature of Mandamus commanding and directing the opposite parties 2 to 5 to restrain the opposite party no 6 to 10 from constructing upon Gata No. 798 which is recorded as Saamanya Abaadi Land in the revenue which is recorded as Saamanya Abaadi Land in the revenue record of village Mohammadpur, Pargana and Tehsil Fatehpur, District Barabanki. (ii) issue a writ, order or direction in the nature of Mandamus commanding and directing the opposite party no 2 to 5 to demolish the illegal structure built by opposite party no 6 to 10 on the drain line intended for the use of public. 3. Learned Standing Counsel based upon the instructions states that the alleged constructions are being done on the 'Aabadi Land'. 4. In view of the said instructions and the pleadings, prima- facie, the element of Public Interest is missing, as such, the petition cannot be entertained. 5. The writ petition is dismissed.
