Neutral Citation No. - 2025:AHC-LKO:5544-DB Court No. - 1 Case :- WRIT - C No. - 617 of 2025 Petitioner :- Smt. Kanti Devi Respondent :- State Of U.P. Thru. Prin. Secy. Revenue Lko And Another Counsel for Petitioner :- Narayan Datt Tiwari Counsel for Respondent :- C.S.C. Hon'ble Attau Rahman Masoodi,J. Hon'ble Subhash Vidyarthi,J.
1. Heard Shri Narayan Datt Tiwari, learned counsel for the petitioner and Shri Tushar Kant Mishra, learned Standing Counsel for the respondent No.3.
2. The petitioner claims her rights on the basis of a sale deed. It is stated that the sale deed was executed in her favour on
30.11.2021. The title of the vendor who has executed the alleged sale deed is not traceable to any revenue records placed on record in the present writ petition.
3. Adjudication of such type of disputes does not lie within the domain of this Court in exercise of its writ jurisdiction.
4. Thus, a writ of mandamus cannot be issued even against the State Authorities unless the title of the petitioner is so clear on the basis of record and the documents of title.
5. Be that as it may, the petition is dismissed with the liberty open to the petitioner to initiate appropriate proceedings before the competent court for seeking the injunctive relief as prayed for in the present writ petition. .
