2. The petitioner is apprehending his arrest in connection with Pindrajora P.S. Case No. 296/2024, registered under sections 303(2), 317(2) of B.N.S., 2023, Section 21 of MMDR Act and section 13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rules, 2017, under section 30( ii) of Coal Mines Act, pending in the Court of learned Judicial Magistrate Ist Class, Bokaro.

Learned counsel for the petitioner submits that the petitioner happens to be the owner of the vehicle in question and allegation is made that coal has been loaded on the said hywa. He submits that the petitioner has already produced the document with regard to coal. He submits that the petitioner has no criminal antecedent which is disclosed in para 9 of the petition. On these grounds, he submits that the petitioner may kindly be provided privilege of anticipatory bail.

Learned counsel for the State opposes the prayer and submits the petitioner is owner of the vehicle in question.

Considering that the petitioner happens to be the owner of the vehicle in question and he has already produced the document with regard to coal and he has no criminal antecedent which is disclosed in para 9 of the petition, I am inclined to grant anticipatory bail to the petitioner. Accordingly, the petitioner above named, is directed to surrender before the learned court within three weeks from today and in the event of his surrender / arrest, the petitioner shall be released on bail, on furnishing bail bonds of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate Ist Class, Bokaro, in connection with Pindrajora P.S. Case No. 296/2024, subject to conditions as laid down under Section 482 (2) of B.N.S.S, 2023.
