THE HON’BLE SRI JUSTICE HARINATH.N CRIMINAL PETITION No.2960 OF 2025 ORDER: 1. Heard the learned counsel for the petitioner. 2. The learned counsel for the petitioner submits that the petitioner was arraigned as A.2 in Crime No.238 of 2024 on the file of the Prakash Nagar Police Station, East Godavari District, registered for the alleged offence under Section 108 of the Bharatiya Nyaya Sanhita 2023. 3. The learned counsel for the petitioner submits that the 2nd respondent and A.1 have business dealings, and the petitioner works in the said shop as a clerk-cum-accountant. It is further submitted that the 2nd respondent lodged a complaint with the police, alleging that her husband had sent a video stating he had committed suicide and holding A.1 and the petitioner responsible for the same. The police have registered a case and the same is under investigation. 4. The learned counsel further submits that the allegations attributing the responsibility for the suicide of the 2ndrespondent's husband to the petitioner do not constitute an offence under Section 108 of the Bharatiya Nyaya Sanhita. Furthermore, as the petitioner has no direct business relationship with the 2ndrespondent's husband and is merely working as a clerk-cum-accountant in the shop run by A.1, he cannot be implicated as an accused in this case. -2- CRL.P. Considering the same, this Court deems it appropriate to dispose off the criminal petition by directing the Investigation Officer/ Station House Officer, Prakash Nagar, East Godavari District, to complete the investigation in connection with Crime No.238 of 2024 without taking any coercive steps against the petitioner/A.2. This would not preclude the investigation officer from submitting a final report or charge sheet. 6. Accordingly, the criminal petition is disposed off. 7.
