Serial No.130 Supp. Cause List IN THE HIGH COURT OF JAMMU & KASHMIR AND LADAKH AT JAMMU TRP (c)/31/2025 SWASTIK CHOUDHARY … Petitioner(s) Through: Ms. Palvi Sharma, Advocate. Vs. BALJEET SINGH ... Respondent(s) Through: None . CORAM: HON’BLE MR. JUSTICE RAHUL BHARTI, JUDGE ORDER 04.11.2025 \R 1. It is too pre-mature for the petitioner to come forward and seek transfer of divorce petition filed by the respondent from the court of learned Principal District Judge Samba to the court of learned Principal District Judge, Kathua on account of the fact that the petitioner is residing with her parents in Kathua where she has also initiated proceedings under Protection of Women from Domestic Violence Act, 2005. 2. The petitioner is yet to cause appearance in the divorce case so filed by the respondent and, therefore, the petitioner is acting purely on misconceived apprehension. 3. As on date, there is no good ground made out for seeking transfer of the petition from the court of learned Principal District Judge, Samba to the court of learned Principal District Judge, Kathua. 4. Let the petitioner appear in the case before the learned Principal District Judge, Samba and in case the petitioner would suffer any hardship in pursuing her case before learned Principal District Judge, Samba then only she can ask for transfer of the case. 5. Disposed of accordingly. (RAHUL BHARTI) JUDGE JAMMU: 04.11.2025 “Opinder”
