Mr. Abhishek Verma, learned counsel for the Petitioner. 2. Mr. G.C. Joshi, learned A.G.A. for the State of Uttarakhand. 3. As per the noting made by the Coordinate Bench dated 26.09.2025, learned counsel for the Petitioner had submitted that the Petitioner was not present at the place of occurrence at the time of the incident, as he had taken his son for medical treatment to Vaish Nursing Home, situated at Sevak Ashram Road, Dehradun. It was further submitted that the Petitioner has been falsely implicated in the present case and was wrongly shown as part of the crowd involved in the incident as narrated in the FIR. 4. Learned State Counsel was accordingly directed to seek instructions with regard to the plea of alibi as raised by the learned counsel for the Petitioner. 5. Today, learned counsel for the Petitioner submits that due to an inadvertent error, the name of the hospital/clinic was wrongly mentioned as “Vaish Nursing Home”, whereas the correct name is “Apollo Pharmacy”. 6. Learned State Counsel, on the basis of the written instructions so received from the Investigating Officer, submits that upon verification, it has been found that the Petitioner was indeed not present at the spot at the relevant time as alleged in the FIR. 7. In view of the above and considering the instructions received from the State authorities, it is evident that nothing adverse has been found against the Petitioner during the course of investigation. 2025:UHC:8923 8. Accordingly, as nothing survives for adjudication in the present writ petition, the same is hereby disposed of. 9. It is made clear that if, in future, any fresh material surfaces against the Petitioner, it shall be open to the Investigating Agency to proceed in accordance with law. 10. The record of this case be consigned to the Record Room after due compliance.
