Heard the learned counsel for the petitioner and the learned Assistant Public Prosecutor appearing for the State. 2. The petitioner was arraigned as A.9 in Crime No.23 of 2025 of Vallampudi Police Station, Vizianagaram District, registered for the alleged offences under Sections 132, 121(1), 74, 307, 79, 49 read with 3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The learned counsel for the petitioner submits that the petitioner is the mother of A.1 and A.7 and that she was not present at the time of the incident, and she has not participated in the alleged incident and hence, the petitioner cannot be attributed with the charge under Section 307 of Bharatiya Nyaya Sanhita. 4. Having considered the submissions of the learned counsel for the petitioner, the Station House Officer, Vallampudi Police Station, Vizianagaram District, is directed to follow the procedure as contemplated under Section 35(3) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar as the petitioner is concerned, for the purpose of investigation in connection with Crime No.23 of 2025. This would -3- not preclude the Investigation Officer to file charge sheet or final report. 5. Accordingly, the criminal petition is disposed off. 6.
