And 3 Others Counsel for Petitioner :- Pravin Singh Counsel for Respondent :- G.A. Hon'ble Mrs. Sangeeta Chandra,J. Hon'ble Om Prakash Shukla,J. Heard the learned counsel for the petitioner and the learned A.G.A. who appears on behalf of the State- respondent nos.1, 2 and 3. In view of the order proposed to be passed, issuance of notice to the Opposite party no.4 is dispensed with. This petition has been filed by the petitioner for the following main prayer:-
"(i) Issue a writ, order or direction in the nature of Certiorari quashing the impugned F.I.R. dated 09.10.2024 lodged by the Opposite party no.4 as FIR/Case Crime No.0344 of 2024, under Sections 419, 420, 467, 468, 471, 506 I.P.C. at P.S. Khiron, District Raebareli, as contained in Annexure No.1 to the writ petition, so far as it relates to petitioner." It is the case of the petitioner that she is a poor lady who does household work and has been falsely implicated in the impugned F.I.R. alleging that she had induced the informant, the opposite party no.4 to buy certain land which was belonging to one Dr. Ishwar Chandra son of Bholuram R/o Birapur, Tehsil Bhadohi, District Sant Kabir Nagar, who is currently residing in House No.492, K-01, Amarnagar, Behind MGIC Ground, P.S. Kotwali City, District Raebareli. It has been submitted that the petitioner has nothing at all to do in the matter. The alleged forged Aadhar card on the basis of which property of Dr. Ishraw Chandra was sold off, has been used by Ram Bahadur. We have gone through the F.I.R. and also the instructions sent by the Investigating Officer, Mr. Sanjay Kumar Sharma, Sub-Inspector of Police Station Khero, District Raebareli, a copy of which has been produced by the learned A.G.A. The Instructions are kept on record which also encloses a copy of the Case Diary and details of the investigation carried out have been mentioned in the Case Diary. The co-accused Ram Bahadur has been arrested and the petitioner is the sister-in-law of such Ram Bahadur. Prima facie the cognizable offence regarding inducing and cheating is made out. This Court, therefore, finds no good ground to interfere in the matter.
Hence, this writ petition is dismissed. Order Date :- 23.1.2025 N.PAL Digitally signed by :- NARESH PAL High Court of Judicature at Allahabad, Lucknow Bench
